These Terms and Conditions (“Terms”) govern your access to and use of prefabhouseusa.com (the “Site”), including any purchases, quote requests, or other interactions made through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

By browsing, creating an account, requesting a quote, or placing an order on this Site, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding agreement, and that you accept these Terms in full.

2. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, legal requirements, or Site functionality. Updates will be posted on this page with a revised “Last updated” date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

3. Use of the Site

You agree to use the Site only for lawful purposes. You may not:

4. Products, Descriptions, and Pricing

We aim to describe our expandable container houses, prefab homes, and related products as accurately as possible, including specifications, images, and available customizations. However:

  • Actual materials, colors, and finishes may vary slightly from images shown due to photography, screen display, or ongoing product improvements.
  • Displayed prices are estimates and may not reflect final project cost, which depends on customization, site conditions, delivery distance, permits, and local requirements.
  • Final pricing is confirmed in a written quote before any order is placed. We reserve the right to correct pricing or description errors and to update prices at any time prior to order confirmation.

5. Quotes, Orders, and Custom Builds

  • Submitting a quote request does not create a binding order; it initiates a consultation process.
  • Many of our homes are built or customized to order. Once a custom order is confirmed and a deposit is paid, production timelines and any applicable cancellation terms will be outlined in your individual sales agreement.
  • We reserve the right to decline or cancel any order, including for reasons such as inaccurate information, site conditions that are not suitable for installation, or inability to fulfill the order as specified.

6. Payment

Payment terms (including deposit amounts, milestone payments, and final balance) will be set out in your individual sales agreement or invoice. All payments must be made through approved methods communicated by our team. We do not currently offer in-house or third-party financing; see our Financing Options page for current status.

7. Shipping and Delivery

Delivery and installation timelines and costs depend on your location, site accessibility, and the specifics of your order, and will be confirmed directly with you before shipment. Please see our Shipping & Delivery page for more information.

8. Warranties and Disclaimers

  • We provide a structural warranty on eligible homes as described at the time of purchase and in your sales agreement or Warranty page.
  • Except for warranties expressly stated in writing, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
  • We do not guarantee that the Site will be uninterrupted, error-free, or secure at all times.

9. Limitation of Liability

To the fullest extent permitted by law, Prefab House USA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim relating to a purchased product will not exceed the amount you paid for that product.

10. Intellectual Property

All content on this Site — including text, graphics, logos, images, floor plans, and design elements — is owned by or licensed to Prefab House USA and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

11. User-Submitted Content

If you submit reviews, testimonials, photos, or other content to us (for example, through testimonials or contact forms), you grant Prefab House USA a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and business purposes, unless otherwise agreed in writing. You confirm that any content you submit is your own and does not infringe on the rights of others.

Our Site may contain links to third-party websites (such as social media or partner sites) for your convenience. We do not control and are not responsible for the content, policies, or practices of any third-party sites.

These Terms are governed by the laws of the state in which Prefab House USA is registered to do business, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Site will first be addressed through good-faith negotiation; if unresolved, disputes may be brought before a court of competent jurisdiction in that state, or resolved through arbitration if separately agreed in a signed sales agreement.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
